Welcome to Errly Aquatics. By accessing our website, placing an order, or using our services, you agree to comply with and be bound by the following Terms of Service. Please read them carefully.

1. Acceptance of Terms

By placing an order or using this website, you acknowledge that you have read, understood, and agree to these Terms of Service. If you do not agree, please do not use our services or place an order.

2. Eligibility

You must be at least 18 years old, or have parental/guardian consent, to place an order.

3. Orders

  • Order Acceptance: Errly Aquatics reserves the right to accept, refuse, or cancel any order for any reason, including stock limitations, shipping restrictions, or suspected fraudulent activity.
  • Pricing & Availability: All prices, promotions, and product availability are subject to change without notice.

4. Live Animals (Shrimp, Snails, etc.)

  • Shipping: We include extra shrimp/snails in each pack to account for natural loss during shipping. We recommend expedited shipping to reduce the risk of death in transit.
  • Refunds/Exchanges: Claims for deceased or damaged animals are generally only eligible if expedited shipping was selected. Ground shipping that arrives in less than 2 days may qualify under special circumstances.
  • Reporting: Customers must submit claims within 1 hour of delivery, providing clear photos and/or videos before opening the bags. Late claims will not be accepted.
  • Liability: Errly Aquatics is not responsible for delays, losses, or deaths caused by the shipping carrier or conditions outside our control.

5. Plants

  • Refunds/Exchanges: Notify us within 2 hours of delivery if plants arrive damaged or in poor condition with photos. Approved claims may receive a replacement, store credit, or refund.
  • Healthy Plants: Once accepted as healthy, no returns or refunds are available.

6. Non-Live Products (Supplies, Food, Equipment)

  • Returns: Non-live products in unopened, original condition may not be returned in most cases.
  • Return Process: Contact us for return authorization. Return shipping is the customer’s responsibility unless the item arrived damaged or defective.
  • Refunds: Refunds will be issued after inspection to the original payment method.

7. Cancellations

  • Live Animals: Orders cannot be canceled once shipped.
  • Non-Live Products: Orders may be canceled prior to shipment for a full refund.

8. Payment

  • Accepted Methods: Major credit cards, debit cards, and approved payment methods.
  • Taxes & Fees: Applicable taxes and shipping fees are the customer’s responsibility.

9. User Conduct

  • You agree not to use our website or services for unlawful purposes, fraudulent activity, or to infringe on intellectual property rights.
  • Account holders are responsible for all activity under their accounts.

10. Limitation of Liability

Errly Aquatics is not liable for indirect, incidental, or consequential damages arising from the use of our products or website. Live animals are perishable; survival after delivery cannot be guaranteed due to factors outside our control.

11. Intellectual Property

All website content, including text, images, branding, and logos, are property of Errly Aquatics. Unauthorized use is prohibited.

12. Governing Law

These Terms of Service are governed by the laws of North Carolina, USA. Any disputes will be resolved in courts located in Wake County, Raleigh.

13. Changes to Terms

Errly Aquatics reserves the right to update these Terms of Service at any time. Continued use of the website constitutes acceptance of the updated terms.
